My husband Rick is a convicted murder.
Rick 20 at this time, came to give his mom Judy a ride to the store.
Judy gave her husband Jimmy his coffee. He takes a sip. Flies into a rage. She didn't put enough cream in his coffee.
He starts choking her. She turns blue passes out. Rick pulls him off his mom. Punches him hard he falls to the floor. Rick tends to his mom. Jimmy gets up pulls shoves Rick out of the way and goes back to choking Judy. She is turning blue.
Adrenaline running high fear he will watch his mom die at the hands of this man. Grabs a cast iron frying pan off the stove and cracks Jimmy over the head hard.
Jimmy is bleeding there is a lot of blood.
Judy comes to tells Rick to go. Between the two they make the fatal decision not to call the police.
When Rick comes back Jimmy is in the closest bedroom dead. He wrapped him in a blanket puts him in the tub.
He digs a hole in a secluded place. He can't bring himself to put this man who had abused him most of his life into this hole in the middle of no where.
Eight days later
There is a smell emitting from Judy's apartment. The police are called. They find Jimmy's body. Rick is arrested
charge: first degree murder cause of death :strangulation.
That was back in 1989 ...
He went to prison for 11 years.
He gets out. A buddy asks for a ride to his mom's. Rick is pulled over on his way back. Appears his buddy robbed the local spur store. Rick was now the get away car. Rick is arrested. His "buddy" said Rick was going to kill him if he did not give him some money.
The store clerk said he was not there. A jailer received a note from his " buddy" saying if he baked some good cake in the kitchen where he worked he would tell them the truth he didn't do it.
Rick gets a visit from the DA .. He said I was going to let you go today. The press is here if I do that it will read DA set convicted murder free on theft charges. He tells him if it goes to trial his past charge will be at play. He offers to drop the charges down to theft of moveable property. A gross misdemeanor he will sit a few months in prison on an atr.
Defeated Rick takes the deal.
